Respondent had sought and obtained against the appellant's declarations, damages and an injunction to restrain the appellants acts of trespass on his land.
Dissatis¬fied, appellants appealed to the Court of Appeal which again refused them an order of perpetual injunction. The appellants then appealed to the Supreme Court.
